Japanese Mother Appeals against the judgment of the High Court

The Japanese national, Nakano Eriko, has appealed against the High Court's ruling on her two daughters.

Nakano's lawyer Mohammad Shishir Monir said the application was made to the relevant branch of the Appellate Division on Sunday (December 5).

Earlier on November 21, the High Court ruled that the two children Jasmine Malika and Laila Lina would be with their father Imran Sharif in Bangladesh.

The ruling said, however, that a mother from Japan would be able to spend time alone with her two children three times a year for 10 days. Father Imran Sharif will have to bear all the expenses of mother's coming and going and accommodation. The cost of coming and going outside of this will be borne by the mother. Parents will talk to their children's mother at least twice during the holidays.

After the verdict, the court directly rejected the writ petition filed by father Imran Sharif to bring back the youngest daughter of the three from Japan. However, their mother's writ will continue.

Advocate Mohammad Shishir Monir was in favor of the Japanese mother in the court. Former Attorney General's lawyer Fida M Kamal, advocate Fawzia Karim Firoz, barrister Kazi Maruful Alam and barrister Faiza Mehrin were on his father's side.

On November 1, the hearing ended on whether the two children would stay with their father Imran Sharif in Bangladesh or leave for Japan with their mother Nakano.

On August 31, the High Court ordered that the parents and two children stay in a four-room house in the capital's Gulshan. They will stay there for 15 days at present. The rent of the flat will be borne by both parties. Later on September 30, the High Court ordered that the mother stay with the two children for 24 hours including night. Father Imran can only meet the children during the day. At this time the rent of the flat should be borne equally by the parents of the children. According to the order, the parents have been staying with the children for so long.

According to Eriko's lawyer Shishir Monir, on July 11, 2008, Dr. Japanese citizen. Eriko Nakano, 48, and Sharif Imran, 56, a Bangladeshi-American, got married under Japanese law. After marriage, they moved to Tokyo. In a family of 12 years, three daughters were born.

They are Jasmine Malika (11), Laila Lina (10) and Sania Hena (6). Eriko is a physician by profession. The three girls were students at the American School in Japan (ASJI) in Chofo City, Tokyo.
