EC Directed to Fix New Date for Noakhali Zila Parishad Election

The Appellate Division of the Supreme Court on Tuesday canceled a High Court order that validated the candidacy of Alabox Titu and directed the Election Commission to fix a new schedule to hold the Noakhali Zila Parishad polls.

A bench of five Justices led by Chief Justice Hasan Foez Siddique passed the order.

Advocate Ruhul Kuddus Kajal appeared for independent candidate Alabox Titu while advocate Momtaz Uddin Fakir represented Awami League nominated candidate Abdul Wadud Pintu.

Advocate Ruhul Kuddus said as the bench canceled the High Court order, the candidacy of his client Titu has also been canceled.

On September 18, Noakhali district returning officer rejected the nomination of Titu on allegation of loan default.

Later Titu appealed to Chattogram Deputy Commissioner’s office against the order which was rejected.

After that he moved to the High Court and submitted a writ petition.

The High Court stayed the nomination cancelling order and directed to allot an electoral symbol to Titu.

The state side appealed to the Appellate Division of the Supreme Court against the High Court order but it passed no order on September 26.

By then electoral symbols for the candidates were allotted and the election was slated on October 17.

On September 27, AL nominated candidate Pintu appealed to the chamber court of the AD seeking direction to stay the High Court order.

On September 28, Chamber Justice M ENayetur Rahim directed the suspension of the election for Noakhali district chairman post and sent the appeal to the regular bench for hearing.

On October 11, the Election Commission suspended the Noakhali Zila Parishad Election until further notice.
