Cancellation Of Caretaker Govt: HC Declares 15th Amendmnet Is Illegal

The High Court has declared the provision of the 15th Amendment to the Constitution, which abolished the caretaker government system, illegal.

The bench of Justice Farah Mahbub and Justice Debasish Roy Chowdhury announced on Tuesday morning.

The High Court said that the basic structure of the Constitution is democracy. And the basic structure of the Constitution was destroyed through the 15th Amendment. Only fair and acceptable elections can establish democracy. The beauty of the Constitution is the empowerment of the people, the people are the source of all power.

Earlier on 5 December, the bench of Justice Farah Mahbub and Justice Debashish Roy Chowdhury set the date for delivering the verdict after concluding hearings on the petition.

On December 4, the court concluded the hearing of two writ petitions challenging the legitimacy of the 15th Amendment.

Several political entities, including the BNP and Jamaat-e-Islami, were involved in the petitions, with most of them advocating for the reinstatement of the caretaker government system.

The 15th Amendment, passed by the ruling Awami League on June 30, 2011, formally abolished the provision of the caretaker government system.
