The
High Court has directed to gradually introduce the biometric system in the jail to
identify the real culprits. The Home Ministry and the jail authorities have
been asked to implement the directive.
At
the same time, the court has declared the arrest warrant against the wrong
accused Zahir Uddin in the sabotage case invalid.
The
High Court bench of Justice M Enayetur Rahim and Justice Md Mostafizur Rahman
passed the order on Thursday (September 9).
Advocate
Mohammad Shishir Monir appeared for the petition and Deputy Attorney General
Bipul Bagmar represented the state.
Earlier last week, the Police Bureau of Investigation (PBI) had reported to the High Court that Mohammad Zahir Uddin of Basurhat in Noakhali was not the real accused in a case filed with the Khilgaon Police Station on charges of sabotage. According to the report, the real accused in the case is Ansari alias Mohaddes, son of Ahsan Ullah of Companiganj in Noakhali.
On
March 10 last year, the same bench of the High Court in an order stayed the
execution of the arrest warrant issued against Zaheer Uddin by the Dhaka Chief
Judicial Magistrate's Court. At the same time, Zahir Uddin of Noakhali directed
the Police Bureau of Investigation (PBI) to investigate whether he was the real
accused in the case.

Additional Superintendent of Police. The report submitted by Sarwar Alam said
that there was not enough evidence to identify Zahir Uddin as the accused in
the Khilgaon Police Station case (No. 12 (4) 13). The real accused is Modasser
Ansari alias Mohaddes.
Advocate
Shishir Monir said police arrested Modasser Anshari, son of Ahsan Ullah of
Shahjadpur village in Kompaniganj, Noakhali, in a case filed with Khilgaon
police station on April 9, 2013. After being arrested by the police, Modasser
hid his name and address and introduced himself as Mohammad Zahir Uddin, son of
Mohammad Abdul Quader of Azgar Ali Mollah Bari Mosque Road area of Basurhat
Municipality, Noakhali. He was released on bail on October 31 of that year and
escaped from Dhaka Central Jail. He applied for bail in the name of Zahir
Uddin.
Meanwhile,
the police filed a chargesheet against Zahir Uddin and other accused on April
8, 2014. The Dhaka Chief Judicial Magistrate's Court issued an arrest warrant
against Zahir on October 11, 2016. In this situation, Zahir Uddin filed a writ
challenging the validity of the arrest warrant issued against him.
