The High Court has ruled that loan defaulters have no constitutional rights.
Justice M Enayetur Rahim and Justice Mohammad Mostafizur
Rahman addressed the High Court bench on Thursday (November 4).
The court made the remarks while hearing the writ petition
of Mohiuddin Siddiqui, a UP member candidate whose nomination was canceled due
to default in a union council election in Sitakunda, Chittagong.
Mohiuddin Siddiqui's lawyer Advocate Rezaul Hossain Morshed
told the court that Mohiuddin Siddiqui could not take part in the election due
to the cancellation of nomination papers. This is curtailing his constitutional
rights. The court then said that the defaulter could not have any
constitutional right. When there was so much desire to participate in the
election, the debt should have been repaid in due course of time.
The court said the law is the same for everyone. Later, the
court removed Mohiuddin Siddiqui's writ petition from the agenda.
